It alway seemed to me that if K made a dispositive ruling before the discovery procedural rulings that it would appear "rude", i. e. stepping on Wells' toes. Now I have no idea how this translates into legal and judicial decorum but I'd bet it's there in some form or another.
So, I always reasoned, Wells had to rule on the discovery procedurals first... and since she couldn't do anything prejudicial to the legal theories SCO presented (which is K's baliwick) she almost had to give them anything which might be pertinent under their bizarre theories.
In fact I almost see this as a good sign. It seems to me she is forcing K to tighten the constraints in his next ruling - and, I'm sure, she wouldn't dream of causing more anguish for her superior without his consent.
So this hints to me that K is going to make some kind of forthright statement dispositive to some of the legal nonsense very soon, before the scheduled discovery hearing so that what remains of discovery can concentrate only upon what reamains of any legal posturing.
Is there a calendar somewhere of what hearings when?
