If you treat the "and/or"s as "or"s, then, according the definition, software which is "implemented in ways that impair user control over: material changes that affect their user experience, privacy, or system security; use of their system resources, including what programs are installed on their computers" is spyware.

How does Windows XP, with its DRM technology (including the ability to disable software the user has installed) not meet this definition?
