I don't actually claim to understand TSG's theory, but as best I understand it they are asserting that they own anything with even the slightest hint of Unix(tm) flavour.  Sort of like me claiming to own the chocolate factory that was five miles from my house, but which I could sniff every once in a while, but there it is.

Under that theory, anything ever done that is in any way related to Unix would belong to them.  Including presumably Poxix(tm), which of course started out as US Government property.  But for sure BSD, Hurd, HP-UX, etc.
