My only thoughts on this would be that Novell are claiming that SCO had no right to enter into the agreements in the first place. Therefore the agreements are essentially invalid, so Novell isn't actually entitled to anything.

If that is the case however, SUN/M$EV1<whoever else has bought a SCOSource License> on the other hand likely would have a claim for fraud.

So to my mind there is a possibility that Novell doesn't actually have a claim to make in this area (lack of specific performance regarding audit of course it still does.)
