Novell would be being forced to accept terms and conditions (i.e. cash value) for a license negogiated by SCO who don't have the standing to make such negotiations.
What if novell consider the rights granted worth $100 million, but are only getting $25 from it. Is that fair?
Again back to the analogy. I sell x's car to Y for $5000 (it's actually worth $10000). Would it be fair to force X to take the $5000 and be done with it? Because it's a done deal after all. [ Parent ]
