I agree it's an interesting situation, I'm certainly waiting to see how it plays out.

The thing I like about my theory is that it would be SUN/MSFT which ended up out of pocket with no rights to show for it. It would also almost certainly make the bankruptcy assets SCO totally valuless to anyone, having a potential claim from SUN/MSFT hanging around.

On the downside it would mean SCO surviving that bit longer.
