In short don't expect anything on these until January and don't bet on before December... though transcripts of the hearings will be interesting.

My guess is that there's at least a 50/50 that SCOX will file BK before any hearing on these issues.   I think (as evidently does Louis Mettler at lamlaw.com) that there is a fairly good liklihood of Novell getting that constructive trust which will force SCOX into BK instantly.

ASB I expect the (BK) courts to put SCOX into deep freeze in Ch 11 rather than proceeding to Ch 7 until there is some resolution to IBM v SCO, but the BK will stall the cases for at least 6 months.

This is pure speculation and my perception of the most likely unfolding of events, but it could easily go any of a number of other ways.   A misstep before the BK court could wind up converting Ch11 to Ch7 instantly.
