Standard Operating Procedures Draft

General News

By JCausey, Section IP-wars.net Site Issues
Posted on Wed Mar 23rd, 2005 at 22:44:45 EST

This is my proposed rewrite of the Standard Operating Procedures for the site. Some minor changes to clear up some things that I think needed it and the addition of a section on Acceptable Use and bit on what may I may do to protect the site.

If interested, you can access a pdf of the redline version. Please note that final formatting and links have not been added to this version. Also, rewrites of both the Privacy Policy and the Operating Instructions (aka FAQs) will be up soon as all three work together to some extent.

Welcome to the official legal "stuff" page of the site. It would be really nice to have a simple set of policies for a site like this, perhaps something like the Golden Rule - you know, do unto others... Unfortunately, the world seems to be full of people bent on destruction and mayhem and a simple policy just won't do in the world we inhabit. Personally, I don't put a lot of faith in long, detailed policies either as someone intent upon abusing the site will find some loophole. Even though we have this long policy, the following statement from mikey sums up the intent of our policies:

Allow the site to be spidered, syndicated, deep-linked, quoted, and distributed as far and as wide as possible. Invite people ... to come up with creative ways to make use of the information. Invite others to mirror the entire ... site in case Jeff gets hit by a bus. Invite others to duplicate the site entirely because they don't like us or what we are saying.

So without further ado:

Comment copyright and ownership:

We have no desire to own your comments. However,by posting a comment here, you are granting ip-wars.net the perpetual, non-exclusive, serial right to display your comment on the page on which it was posted by you and stored in the site database. It may also be displayed on other pages within the site, or reachable through searches or other means.

By posting a comment here, you are granting ip-wars.net permission to allow the use of your comments pursuant to the attribution, share-alike CCL. Effective Nov. 12, 2004 at approximately 11:07 a.m. EST, the site and all contributions are licensed under an attribution, share-alike CCL, so it is possible other sites or Internet users may grab your comments off of here pursuant to that license. In addition, any material posted here prior to Nov. 12, 2004 at approximately 11:07 a.m. EST was licensed under an attribution, non-commercial CCL, and such license continues to apply to those contributions. There is no attempt to prevent mirroring, spidering, searching, or caching of the site. So who knows where your stuff may end up.

By posting here, you also grant us the right to remove your comment if we choose not to want it here. We do not edit comments, except in extreme cases of comments which include html or other characters that damage the usability of the site. We do NOT remove comments that are inappropriate or offensive to the admins. We trust our users will use the rating system to mod these down to invisibility. Luckily, Scoop has features built in to prevent crapflooding, so hopefully this will not be a problem. If you violate someone else's copyright, we may take action to remove the offending material, especially if the copyright holder requests this.

You lose no copyright control over your words, and are not beholden to us in any way shape or form.

ip-wars.net claims no liability for the accuracy of user's comments, and reserves no ownership of them whatsoever.

Acceptable Use

The ip-wars.net web site exists to provide an open forum for discussion of a variety of topics. As such, I normally do not try to enforce any rules like "no obscenities" or "no sexually-oriented" posts or etcetera. We would prefer that you not do that and trust the community to use the site's features to maintain civility. However, to the extent that the capabilities of the underlying site software (the Scoop system) proves to be inadequate in addressing potential abuses of the site, we reserve the right to take additional measures to protect the integrity of the site. In all cases, should you be notified by the site owner through e-mail or posting on the site that your activities warrant a violation of the acceptable use of the site, you agree to cease such activities or be in violation of the terms of use of the site.

Comments and articles are not prescreened by the site owner. If the site owner becomes aware of inappropriate usage of the site, the site owner may respond at his sole discretion. However, ip-wars.net nor the site owner are in any way responsible for content posted on the site.

We reserve the right to modify this policy at any time. Please direct all questions regarding this policy to jcausey@ip-wars.net (be sure to read the disclaimer below before sending an e-mail).

Third party materials submitted to IP-wars.net:

By its very nature, articles and comments on this site may include materials from third parties that are available here under license terms not consistent with this site's license. For example, material may come from a site that allows its use, but forbids it being re-released under a different license from that of the parent site. Or, the material may already be public domain and this site's license may represent an impermissible additional restriction. In these cases, further use of these materials should be consistent with the original license. In other words, we do not trump the original license for the material. So if you are a "downstream" user of information from this site, please be mindful of what license may apply.

Attribution:

Plan to use material from this site pursuant to the license? You are required to provide attribution. We ask that this be done by identifying the username of the poster (of the article or comment) and that it came from ip-wars.net. E.g., JCausey at ip-wars.net said...

Article Contributions:

Contributing an article (including articles in the Diary section) here means that you grant ip-wars.net perpetual, non-exclusive, serial rights to publish it online, at ip-wars.net, and syndicate the title through our RDF backend. You also grant us the right to edit or remove your contributions as necessary, though we will take great pains to ensure the meaning remains intact.

You also, by submitting a contribution here, warrant that it is your original writing, and not plagiarized from any other published source. ip-wars.net is not responsible for checking the accuracy or originality of any submission, nor will we be liable for plagiarism or the truth or lack thereof of any submission.

E-mail to the site owner:

WARNING:

Are you interested in sending an e-mail to me? Well please be aware:

I reserve the right to use any e-mail you send to me as either a testimonial of how great ip-wars.net is or me personally, or as evidence of some of the stupid stuff sent to me via e-mail. If you do not want your e-mail to be used in such a manner, don't send it!!!

Note: All materials submitted by JCausey prior to the license change date indicated above may be considered covered by either license. You may need to contact individual posters regarding materials posted prior to that date if there is a problem due to the change in license.

Looking to disrupt the site?

I have no idea why someone would want to disrupt a free site. Nevertheless, there are people in this world who seem intent on increasing the "noise" here at the site through crapfloods, spam, and generally useless, insulting drivel that they think passes as meaningful commentary. Apparently, if I look at it generously, their sole interest is to annoy us. If I'm not so generous, I start wondering about who would be interested in stopping a web site that examines threats to FOSS.

Anyway, if you are one of the people interested in disrupting the site, please be aware that I may use a variety of resources available to me to protect the site and keep in running. This may include features built into the Scoop software, steps that involve the server itself, or involvement of third parties where necessary (e.g ISP's or appropriate law enforcement authorities). Oh yeah, you may get your username listed on the Administrative Actions page as well.

So instead of trying to prove how sneaky, cunning, l33t, or whatever you are, why don't you take the time to write an article about an intellectual property issue?

Bye bye spambot (none / 0) (#21)
by Potential Recruit on Tue Nov 28th, 2006 at 12:02:44 EST
This used to be a spambot post that is flooding the site. Due to volume, I had to resort to this while I work to block access by these bots. My apologies - thanks for your patience.
