General News

By JCausey, Section IP-wars.net Site Issues
Posted on Tue Jul 19th, 2005 at 23:37:01 EST

First of all, thanks for finally getting my name in your lawsuit, although I see that you still think I am also known as IP-WARS.NET. And, in paragraph 30 of the new, "amended" complaint posted on your merkeylaw.com site, it would appear that I am a web site. Please rest assured, I am actually a real live person.

Speaking of which, if you file that amended complaint, you realize paragraph 30 is false as you state:

The address and location of defendants is believed to be within the State of California, but is unknown at the present time.
You no longer believe that I'm sure based on the two telephone calls you have made to me during which I verified that I am located in North Carolina.

More importantly, I want to thank you for helping propel ip-wars.net into the top 100,000 sites according to netcraft.com. I'd say sometime in the last 10 days the site broke through 100,000 and I'm sure a lot of it has to do with folks following the news of your lawsuit. And, ip-wars.net is the third result in a search on your name. Cool!

OK, I don't really thank Jeff Merkey for helping with the site. My thanks really go to all of our contributors, registered users, and visitors. The occasion of breaking into the top 100k provides a nice point of reference for me to extend my thanks to everyone. It has not always been easy and I am still searching for ways to improve the site (so yes, I am following your comments and threads even if you don't see me posting in them). I know the changes sometimes seem a little slow in coming - alas, real life intrudes. Nevertheless, THANKS and please keep up the great work!

Jeff

Are you going to need a legal defense fund?

See here for the pdf of the complaint from Pacer.

Did you know OSS supporters are "unwitting participants in the wholesale technology theft... and sponsors of the creation of weapons of mass murder and destruction"?  Gotta love it.  See ¶49

So you admit to "hack[ing] search engines on the Internet through google spamming, google bombing, and other unlawful practices designed to tamper with Internet hosting computers and search engines"?  I feel a motion for PSJ coming on...

...No, No, wait.  That was just a bowel motion.  Easy mistake.

Only the June 21 writing has been filed. All the others are pure rubbish; if you do not file them, they do not count.  Though it would be useful if someone in Utah could check regularly in the future.

They are all full of terrible errors, and spelling mistakes ...  for instance Czechoslovakia has not existed since 1993.  The article posted was taken from the court records directly, and not passed on by any other party.

I have collected nine postings from merkeylaw.com,
the June 21 being the first.

I doubt the federal courts have the freedom of a small town magistrate, but I've heard second hand where the local-sue-everybody-for-everything loon's cases keep getting shuffled and rescheduled until he misses a court appointment and then peremptorily dismissed.

Probably the fed courts don't have that kind of self defense mechanism; but some sua-sponte motion to dismiss by the court is not unlikely, otherwise any response by any defendant pointing out a procedural error is likely to result in a complete dismissal.

I would bet money there's a green star, or piece of yellow tape, or orange bookmark, or blue paperclip attached to this which will let any hearing judge know this is squirrel bait, and "dismiss for any possible reason".

IANAL, just pointing out that bureaucracies do develop some mechanisms to cope with idiocy on this scale.   They don't work as well as might be desirable, but at some level they are likely to kick in.
