I have had a tin-foil hat moment over the recent events at GL/SCOX, please bear with me.
I have noticed, as a long time lurker, that the run up to the current situation has a lot of similarities to the position just prior to the last GL v Yahoos debacle. This is all IIRC, I have done no searches.
Just before John Gabriel was expelled from GL, I had been pleased to note that there seemed to exist a situation in which GL and the SCOX board were vying to get reports and fillings out on the web first. I found this quite exciting, and looked forward to the more or less constant flow of information about the SCO case. I was just starting to think that the SCOX board posters were edging ahead, when PJ dropped her bombshell and the IBM/SCO research effort changed overnight. The camaraderie that had built up, and which even a lurker like myself could feel, was gone, never to return. There followed a period, as you all know, where anybody wishing to discuss GL or PJ were hounded from pillar to post, and the BGE as they became known, eventually gave up the unequal struggle. The SCOX board languished for a long time after these events seeming to have had the stuffing knocked out of it.
Over the last few months however, thanks mainly to the efforts of Al Petrofsky, the SCOX board has again been getting the court documents first, up to a week in some cases, and discussing them at length. I have seen posts on GL where people there have been aware that things had happened in the case, but due to PJ's refusal to acknowledge Al's site, were left in the dark. I got the impression that GL found itself in a position where the only current info was SCOX info. and PJ could not take advantage of it in a timely manner. I think that this state of affairs once again got to her (she made several disparaging remarks about the SCOX board over the last few weeks) and her recent outburst has once again polarized the SCOX board members.
(Tin-foil on) I think that she was perfectly aware of the effect her post would have and she must have chosen both her words (she says she is a writer now) and the moment, with care. Unlike after the first Grokwar, the mood on the SCOX board seems more resigned, and conciliatory, with posters I consider to be GL fans being quite mellow in their positions, even Tim sounded reasonable, he even criticized PJ. NB. The last time I can recall him using a style similar to this it turned out he was lying. joke joke! In the future I expect to see Anon. posters on GL directly posting info that the SCOX board has unearthed, in a new found "spirit of cooperation", and PJ openly making use of it. Al will become isolated, and I expect he will just fade from the scene, but I hope not.
These are just my opinions and IANAL.

Anyway, back in the beginning of January his case was dismissed as being without merit. According to his site, he filed an appeal on January 18th. You can see the Notice of Appeal here.
So, I'll ask here and see what might show up.
I think I may have the opportunity to architect the complete IT infrastructure for a startup company. If I get the chance, I hope to start them all off on Linux and other F/OSS apps from the get go. From what I follow, I know one of the biggest challenges with migrations seems to be getting folks off of Exchange server/Outlook. Since I probably won't have to do that, my question is - what would be the best solution to start everyone on?
Any ideas/suggestions?
Thanks,
JCausey
Anyway, I just happened run across a beta of a new product from Nero for a Linux version of their Burning ROM application. I'm doing a little testing right now and it seems to be pretty nice. Not as nice as k3b that I normally use. And it does not appear to be open source by any stretch of the imagination.
So, probably not for me or most of the folks that visit this site. The bigger picture though is the fact that Nero is probably responding to customer demands to port their application over to Linux. I take that as good news!

I guess with the Vista delay and the rest of the world moving ahead quickly, it's time to crank up the FUD.

Patent spat forces businesses to upgrade Office
Yep - Office, as in the Microsoft Office product. If you read the article, you'll see that some analysts are wondering how well MS'es indemnity will hold up, especially for a company that delays in deploying the "fix". As they point out, for extremely large companies, deploying the "fix" is no easy effort or project.
You would think there would be a larger market for an offering similar to OSRM's, but targeted at users of closed source software. It seems there would be much more incentive to invest in that type of protection.
Patent licensing under scrutiny in BlackBerry case
It's too bad it has taken something like the loss of crackberries for this issue to gain traction, but at least some folks are starting to wake up. From the article, I don't think Rep. Davis fully understands the nature of the problem of software and business method patents as he seems to think throwing some more money/resources and a few procedural changes will fix things up. In any case, there may be an opportunity for some education.

Google Infringes On Nude Photo Site: Court
This was in the Central District of California. It would seem to be in direct contradiction to the Kelly v. Arriba case in which thumbnails returned as part of a search were ruled a fair use and no violation of copyright law by the Ninth Circuit Court of Appeals which covers California's Central District.
High migration costs holding back Linux
Is it just me, or does the only thing the article really say is "Don't use Linux if you have a Windows app you rely on"? They don't provide any numbers that I can tell related to what a "high" migration cost is. Further, right at the end the Gartner spokesperson indicates "it is too early to determine its level of compatibility and fidelity with enterprise Excel applications and complex Word documents." If it is too early to tell, then how does one arrive at a conclusion?
