New Documents in Eagle v Does Case

There has been some "action" recently related to the Eagle lawsuit in which they were suing several posters to the Yahoo! EAG message board. After much speculation in the last couple months, some declarations have been filed explaining how one of the attorney's, Broiles, abandoned one of the defendents - Doe 2.

We also now have a declaration from Doe 2 and a Supplemental Reply in Support of the Motion to Strike. Combined, I found these the most interesting reading as they appear to lay the groundwork for getting the Motion to Strike granted on behalf of Doe 2. As we now learn, Doe 2 never owned any EAG stock nor was Doe 2 ever employed by a competitor or part of any stock scheme. Although I read through it pretty quickly, I thought Doe 2's attorney made some pretty good arguments in the Supplemental Reply in Support of the motion to strike. Nevertheless, I'm sure Eagle will provide arguments to counter at least some of this (they are attorney's after all).

I have not had time to really go through these items in depth - just a quick scan as I am about to head out of town. I also do not know how they relate to the document/item numbers maintained on Al's site documenting this case. Perhaps he will pick these up and figure out where they belong. In the meantime, I'm making them available here with some temporary names.

I could read one .pdf finally, about the abandonment of Doe 2 by his attorney.

Couldn't read the file about eag's petition to seal the record.  Looks interesting, now why would eagles attorneys want to seal a record about how they lost a case and have to pay SLAPP suit fees to the victims?  Curious minds would like to know.

question was raised that eag might not have the funds to pay bender atty fees?
how long does court give for the fees to be paid and what punishment if they dont?
would that be contempt of court if it isnt paid which would then be personal liability on their own freedoms till it is paid?
interesting?
what does fcrp say?
