Some time ago I suggested that before you give your money to any Foundation or F/OSS evangelist that you check to make sure they actually intend to use your contribution to support our agenda. There is nothing to be gained in funding a continued stalemate or listening to pundits who say that legal reforms simply aren't possible here in the United States.

Darth Stallman? Redux

If you don't know what to get for those "hard to shop-for" persons in your life for a birthday or a special occasion, here's a bit of really ancient wisdom:

In "Darth Stallman" and "Darth Stallman? I think it's easier to explain than that" Mikey took a sarcastic jab at some of my posts, and Peragrin explained that the most simple explanation would suffice without resorting to any wild conspiracy theories.  

It isn't a conspiracy at all when the principals themselves publicly ask for summit negotiating proposals about legal defense funds under the EFF or FSF, and then execute their plans later in broad daylight with a lot of fanfare while specifically mentioning their associations with each others organizations. I felt that when it became very clear what was going on last year, the silence about the whole situation in the IT press got even more embarrassing.

I think that sometimes we ordinary folks forget that almost every story that we read or hear about "Free" or Open software is coming at us with a whole lot of "spin" on it in the first place. There are very few forums where you can present all of the relevant facts.

I could write a series a short articles about this topic, but it would take a very long time to get everyone up to speed on the historical developments. Here is long discussion of a little known chapter in Linux history for those who are interested. I'll do another diary on the Lasermoon FT/Caldera development later on.

The Antitrust Essential Facilities Doctrine

People are once again wondering out loud what terms the EU antitrust regulators will accept in their battle to stop Microsoft from illegally leveraging their desktop monopoly. Microsoft has ignored objections from regulators before. The company has used the Windows client to gain unfair advantage in the market for server operating systems. So far they have paid little, if any, penalty.

The "essential facility" doctrine has been articulated as a subset of the so-called "refusal to deal" cases which place limitations on a monopolist's ability to exclude actual or potential rivals from competing with it. The doctrine is one long-standing limitation on the general rule that a firm has no obligation to deal with its competitors. I read JCausey's Diary with some interest today. I found the portion that said:

That led to some discussion about making sure we keep an open mind when presented with information that contradicts our (previously) firmly held beliefs.

I think that most of the problems people here have in dealing with discussions about Groklaw are those based upon some sentimental belief in PJ, and not upon any facts that they possess about her, or any errors in the reports we have been providing to them.

I've seen a lot of debate and discussion both here and elsewhere about Groklaw. Oddly enough my viewpoint is seldom represented in the comments I see from others in the community. I thought I'd put in my two cents worth on the off-chance that there are some others that feel the same way I do.
